TERMS AND CONDITIONS — PROMPTPACK

1. About Us

PromptPack is a trading name of BOOP Consulting, a business operating in South Africa. When you purchase from promptpack.co.za, you are entering into a legally binding agreement with BOOP Consulting t/a PromptPack.

Note: BOOP Consulting is not a registered company (Pty) Ltd. It is an unregistered business trading under the name PromptPack. These Terms remain valid and enforceable under South African common law and the Consumer Protection Act.

2. Digital Products & No-Refund Policy

All products sold on promptpack.co.za are digital downloads (AI prompt bundles). Due to the nature of digital goods, all sales are final. No refunds, exchanges, or cancellations will be accepted once a product has been delivered or made available for download. By completing a purchase, you acknowledge and accept this policy in full.

3. Licence — What You May Do

When you purchase a PromptPack product, you are granted a personal, non-exclusive, non-transferable licence to use the prompts for your own personal or internal business purposes. You may:

  • Use the prompts with AI tools such as ChatGPT, Claude, or Gemini.
  • Adapt or modify them for your own personal or business use.

4. Restrictions — What You May NOT Do

The following are strictly prohibited and constitute infringement of BOOP Consulting's intellectual property rights:

  • Reselling, redistributing, or sublicensing any PromptPack content, in whole or in part.
  • Sharing, gifting, or transferring your purchased files to any third party.
  • Repackaging our prompts as your own product or as part of another product for sale.
  • Uploading or publishing PromptPack content on any marketplace, website, or platform.
  • Claiming authorship or ownership of any PromptPack materials.

5. Intellectual Property & Enforcement

5.1 General

All content sold through PromptPack — including prompt text, bundle structure, naming, and formatting — is the exclusive intellectual property of BOOP Consulting. It is protected under South African copyright law and applicable international intellectual property treaties.

BOOP Consulting will actively pursue legal action against any individual or entity found to be copying, reselling, or misappropriating our products. This includes, but is not limited to, claims for:

  • Copyright infringement
  • Damages and lost profits
  • Legal costs on an attorney-and-own-client scale

5.2 AI-Generated & Standardised Content

PromptPack products are standardised digital goods. The content you receive may be identical or substantially similar to that purchased by other customers — this is by design and does not affect the validity or value of your purchase.

BOOP Consulting expressly reserves the right to use artificial intelligence tools (including but not limited to ChatGPT, Claude, Gemini, and similar platforms) in the creation, development, refinement, and promotion of our products. By purchasing from PromptPack, you acknowledge and accept that:

  • Our products may be wholly or partially created using AI tools.
  • AI assistance in production does not diminish the intellectual property rights held by BOOP Consulting.
  • Standardised content is not grounds for a refund, dispute, or chargeback.

All AI-assisted content is reviewed, curated, and packaged by BOOP Consulting, and remains our exclusive intellectual property.

6. Right to Cancel or Revoke Access

BOOP Consulting reserves the absolute and unconditional right to cancel, suspend, or revoke access to any product, order, or account at any time, for any reason, at our sole discretion. This includes, but is not limited to, cases where we suspect:

  • Violation of these Terms
  • Fraudulent, abusive, or unlawful activity
  • Misuse or unauthorised distribution of our products
  • Chargebacks or payment disputes filed in bad faith

In the event of revocation due to a breach of these Terms, no refund will be issued. BOOP Consulting accepts no liability for any loss or inconvenience resulting from the exercise of this right.

7. Disclaimer of Warranties

PromptPack products are provided "as is." We do not guarantee that the prompts will produce specific results, as outputs depend on the AI platform used and your individual application. Results may vary.

8. Limitation of Liability

To the maximum extent permitted by law, BOOP Consulting shall not be liable for any indirect, incidental, or consequential damages arising from your use of our products.

9. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

10. Updates to These Terms

We may update these Terms from time to time. The current version will always be published on promptpack.co.za. Continued use of the site constitutes acceptance of the updated Terms.
